The following terms and conditions will apply to the use of the online store located at www.greekherbay.com. Every user who enters and transacts or uses the services of the online store (hereinafter referred to as "visitor" or/and "user" or "customer" depending on whether they simply visit the store or place an order) is considered to consent and unconditionally accept the following terms stated here, without any exception.

If a user does not agree with these terms, they are responsible for refraining from visiting, using the website, and from any transaction or use of the online store's services.

Please read these Terms, the Cookie Policy, and the Privacy Policy (collectively referred to as the "Data Protection Policies") carefully before using this website. By using this website or placing an order through it, you agree to be bound by these Terms and the Data Protection Policies. If you do not agree, do not use this website.

These Terms may be amended. It is your responsibility to read them periodically, as the Terms in effect at the time the Contract (as defined below) is concluded will be the applicable ones.

2/ YOUR INFORMATION AND VISITS TO THIS WEBSITE

The information or personal data you provide to us are processed according to the Data Protection Policies. By using this website, you consent to the processing of such information and data and declare that all information and data provided by you are true and accurate.

3/ PROVIDED INFORMATION & PRODUCTS

This website is committed to the accuracy, truthfulness, and completeness of the information presented, concerning the identity of the company as well as the transactions provided through the online store. Within the bounds of good faith, www.greekherbay.com is not responsible or bound by data entries made by mistake/oversight during common experience and is entitled to correct these whenever it becomes aware of their existence.

4/ HOW THE CONTRACT IS CONCLUDED

The information contained in these Terms and the details on this website do not constitute a sale proposal but an invitation for information. No contract shall be deemed to have been concluded between you and us regarding any products, except when your order is expressly accepted by us. If we do not accept your order and the funds have already been deducted from your account, they will be refunded in full.

To place an order, you will be asked to follow the purchase process and press the "Approve Payment" button. You will then receive an e-mail from us confirming the receipt of your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted, as this constitutes an offer from you to us to purchase one or more products. All orders are subject to acceptance by us, and such acceptance will be confirmed by sending you an e-mail confirming that the product has been dispatched ("Shipment Confirmation"). The contract for the purchase of a product between us ("Contract") will only be considered concluded when we send you the Shipment Confirmation.

The Contract will relate only to those products whose dispatch we have confirmed in the Shipment Confirmation. We are not obligated to supply any further products that may be part of your order until the dispatch of such products has been confirmed in a separate Shipment Confirmation.

5/ ORDER REJECTION

We reserve the right to withdraw any product from this website at any time or/and to remove or edit any material or content on this website. Although we make every effort to process all orders submitted to us, exceptional circumstances may arise that require us to reject the processing of an order after sending the Order Confirmation, which we reserve the right to do at any time at our sole discretion.

We bear no liability to you or any third party for withdrawing any products from this website or for removing or editing any material or content on this website or for refusing to process or accept an order after we have sent you the Order Confirmation.

6/ LIMITATION OF LIABILITY

The online store www.greekherbay.com is not liable and is not obliged to compensate for any damage or loss resulting from the cancellation of orders, failure to execute or delay in their execution, for any reason. It does not guarantee the availability of the products displayed in the online store, but it informs the interested customer based on the data kept about the availability or non-availability and undertakes, in case of changes, to inform customers timely about the non-availability, without bearing any further responsibility. The online store provides the content (e.g., information, names, photos, depictions), products, and services available through the site "as is." In no case is www.greekherbay.com liable civilly or criminally for any damage (positive, special, or consequential, which indicatively and not restrictively, alternatively and/or cumulatively constitutes loss of profits, data, lost earnings, monetary satisfaction, etc.) that a visitor of the online store or a third party may suffer from a cause related to the operation or non-operation or/and the use of the website or/and the inability to provide services or/and products or/and information available from it or/and from any unauthorized interventions of third parties in products or/and services or/and information available through it.

7/ RISK TRANSFER AND PRODUCT OWNERSHIP

Responsibility for the products passes to you when you or a third party appointed by you, other than the carrier, has acquired physical possession or control of the products.

Ownership of the products passes to you either with our full receipt of all amounts due regarding the products, including shipping costs, or upon their delivery if this occurs later than the receipt.

8/ TRANSFER OF RIGHTS AND OBLIGATIONS

The performance of our obligations under any Contract is deemed suspended for the period during which the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
